What Should I Do If I Have Been Injured?

Many factors are involved in settling a premises liability case. If you've been injured due to an unsafe condition on someone's property, it's important to contact West Seegmiller soon after your injury to discuss your case in detail. An early investigation is important to the success of the case.

Proving Negligence

Proving negligence is difficult. The evidence often disappears because the problem is quickly repaired. If possible, take photographs of the accident scene and your injuries, plus write down the names and addresses of any eyewitnesses. Just because you were injured on someone's property is not proof of negligence. The property owner has to be proven negligent (has done something wrong or unsafe).

The owner of the property must pay for losses caused by the dangerous condition of the property if the injured person can prove:

  • The condition of the property was dangerous.
  • The owner knew, or should have known, about the dangerous condition.
  • The owner had a reasonable opportunity to correct or warn of the condition, which was not reasonably open and obvious to the injured party at the time of the accident.
